Ensuring Your Visitation Rights

If your ex-partner is the primary custodial parent of your child, it can be hard enough to only see your child a couple days a week. But the worst feeling is when they actively keep your child from you—whether it’s a one-time instance or them repeatedly, blatantly ignoring your scheduled visitation.

What Is Standard Visitation in Texas?

When parents don’t agree on set times for visitation, the Texas Family Code has a designated standard amount of time. It changes slightly based on time of year (summer versus school year) and on how far apart the two parents live.

If you live nearby, you’re entitled to:

  • The first, third, and fifth weekends of each month
  • Thursday overnight (if you live close enough to the other parent
  • Alternating holidays
  • An extended time (30 days) during the summer break

You can amend the standard visitation as you work through your divorce or other child custody proceeding . If one is already in place but it doesn’t cover what you need, we can work together to get the agreement amended.

When There Is No Court Order or Agreement

If there is no agreement in place, this can cause confusion and disagreements. Legally, you have the right to see your child, but you cannot do any enforcement action to force the other parent to let you see them.

Can I Still See My Child Even If I Haven’t Paid Child Support?

Yes! Custody and child support are separate issues, according to Texas’s legal system. If you have failed to pay child support, you are still entitled to your visitation rights.
