Custody of the child or children is always a difficult situation. It’s especially hard when you’re not sure that the other parent will be cooperative or that they’ll follow the agreement for visitation, child support, or other aspects of co-parenting.

The Result: Sole Custody or Joint Custody
Texas law dictates that courts do what is in the best interest of the child. For most families, this means some version of joint custody for the two parents, where you and your spouse detail out when the child is with each parent and what kind of child support is needed.
In some cases, the court will determine sole custody to one parent or to another person or couple. This is common when abuse or mental health issues result in danger to the child or when there is an absent parent. For most cases, though, it’s beneficial to have both parents caring for the child.

Even in standard two-parent relationships, custody can be difficult to establish. It becomes even more difficult in cases of abuse or neglect or when one or both parents are dealing with addiction. Often, the child has been taken care of by extended family or foster parents and has been involved in Child Protective Services (CPS).
